Indian man wins racial discrimination case against KFC franchise in UK, gets THIS much compensation
It was in 2023 that Ravichandran started working at the West Wickham outlet of KFC. He was interviewed by Kajan, whom he reported directly.
London: An Indian man, hailing from Tamil Nadu, won a race discrimination case against his KFC outlet manager in South-East London. During the hearing, the tribunal granted him compensation of nearly 67,000 pounds.
Ravichandran accused the Sri Lankan boss of racial discrimination
The man, Madhesh Ravichandran, told the tribunal that his Sri Lankan boss made racial discrimination against him and referred to him as ‘slave’ and ‘Indians are fraudsters, which were directed at him. Judge Paul Abbott upheld his claims against Nexus Foods Limited. "The complaints of direct race discrimination are well-founded and succeed,” the judgment read.
It added, "We have found on the facts that the claimant was subjected to the less favourable treatments… his holiday request was refused because he was Indian and [restaurant manager] Kajan wished to prioritise requests from Sri Lankan Tamil colleagues, and he was referred to as a ‘shit’ and a ‘slave’ which is self-evidently less favourable treatment because of his race.”
Victim joined KFC outlet in 2023
It was in 2023 that Ravichandran started working at the West Wickham outlet of KFC. He was interviewed by Kajan, whom he reported directly. After facing problems for months, the matter further increased in July when Ravichandran was forced to work excessive hours on a shift.
"This racial abuse from a manager had, we find, the purpose and the effect of violating the claimant’s dignity,” reads the judgment. The court noted that Ravichandran was "summarily dismissed” while serving out his notice. He was denied his right to one week’s notice.
Claimant was wrongfully dismissed: Tribunal
"It was not asserted by the respondent that the claimant had done anything to entitle it to dismiss the claimant without notice. The claimant was, therefore, wrongfully dismissed and is entitled to be paid one week’s pay instead of notice,” the judgment added further as per PTI.
The tribunal also asked Nexus Foods Limited to follow "a training programme for all employees concerning discrimination in the workplace, such programme to include training for managers on appropriate handling of grievances in this regard” within six months of the judgment.
