A sensational divorce case before the Supreme Court is sparking debate over the limits of alimony awards, particularly in short-term marriages. A woman is seeking ₹12 crore in alimony, a Mumbai flat, and a BMW following an 18-month marriage to a wealthy man.
The Chief Justice of India, B.R. Gavai, expressed concerns about the extravagant nature of the claim, especially considering the woman holds an MBA and has experience in the IT sector. He questioned whether such demands are justified after such a brief marriage, highlighting the need for financial self-reliance.
The woman's defence argued her husbands wealth justifies the claim and accused him of falsely alleging she has schizophrenia and causing her job loss via a false FIR. The husbands counsel countered that the demand was excessive, pointing out that the woman already lives in a Mumbai flat and that the requested BMW is a discontinued, older model. He also alleged the wife reneged on a previous mutual settlement.
The court, while reserving its final order, offered a compromise: a debt-free flat or ₹4 crore, coupled with a suggestion that the woman re-enter the IT workforce. This decision highlights the central question in the case: where should courts draw the line between providing fair maintenance and fulfilling aspirational claims?
