Pathanamthitta: The Thiruvalla magistrate court order denying bail to Palakkad MLA Rahul Mamkoottathil in the third sexual assault case has outrightly rejected his claim that the relationship with the complainant was consensual. The court while passing the order noted that Rahul had induced the survivor to book the hotel room in his name to guard his privacy and hence not reveal his identity.
As per the Special Investigation Team(SIT), Rahul wanted the survivor to book the room in her name although she had told him that a meeting at a restaurant was sufficient. Rahul, meanwhile told her that he was a popular figure and that people would recognize him.
The survivor also told the SIT that Rahul had admonished her for providing his name as Rahul BR in the hotel registry entry form at the reception.
According to the survivor, she was under the impression that they could go out once Rahul arrived the hotel. According to the FIS she was sexually assaulted after Rahul entered the room. The statement also stated that he had beat her and spat on her face while in the room. The survivor got pregnant which later lead to miscarriage.
According to the survivor Rahul also threatened her that her husband’s family would discover the relationship and told her abut the probability of her father having a heart attack and challenger her to take action against him.
The survivor also told the court that she was terrified to lodge a complaint as it could backlash where she would be subjected to cyber bullying like other victims faced in similar cases.
