Public health over prison: Vaccine scientist’s conviction suspended by Uttarakhand HC in wife’s suicide case
The Uttarakhand High Court has suspended the conviction of vaccine scientist Dr. Akash Yadav, accused of abetting his wife's suicide, citing his vital role in public health. The court said his continued conviction would harm national interest amid ongoing vaccine research efforts.
Nainital: In a significant decision, the Uttarakhand High Court has suspended the conviction and sentence of Dr. Akash Yadav, a vaccine scientist and IIT Kharagpur alumnus, who was found guilty of abetting his wife’s suicide.
The court cited national interest and public health concerns as key reasons for granting relief.
Scientist was convicted for abetment to suicide by a sessions court in Rudrapur
Dr. Yadav, a senior manager at Indian Immunological Limited (IIL), was convicted under IPC Section 306 for abetment to suicide by a sessions court in Rudrapur earlier this year. He was sentenced to five years of rigorous imprisonment and fined Rs 20,000. However, he was acquitted of charges under Section 304-B (dowry death) and the Dowry Prohibition Act.
The case dates back to 2015, when Yadav’s wife, employed at Pantnagar University, died by suicide. She had returned to her maternal home in July while Yadav was working in Hyderabad. In her suicide note, she held her husband responsible for her death.
Yadav filed an appeal seeking suspension of his conviction
After being granted bail, Yadav filed an appeal seeking suspension of his conviction, arguing that the sentence had disqualified him from continuing his scientific duties at IIL. His counsel emphasized that Yadav’s work in vaccine research and development was of national importance, and his conviction was obstructing critical public health efforts.
Convictions can be suspended if they cause irreversible harm to public interest
Justice Ravindra Maithani, who heard the case, accepted the argument and cited Supreme Court precedents, including the Navjot Singh Sidhu vs State of Punjab and Rama Narang vs Ramesh Narang cases. The court noted that in exceptional situations, convictions can be suspended if they cause irreversible harm to public interest or professional standing.
"This is a greater issue of public health and national interest,” the bench observed. "The scientist is directly involved in vaccine development, and his conviction prevents him from performing duties that are vital to society.” The court ordered a stay on both the execution of the sentence and the conviction itself, allowing Yadav to resume his role at IIL while the appeal remains pending.

Dr. Yadav holds a PhD in Biotechnology from IIT Kharagpur and has been working with IIL for the past three years. The company plays a key role in India’s national immunization programs, producing vaccines for both human and veterinary use.
The case has sparked debate over balancing legal accountability with professional contributions to public welfare. While the final verdict is yet to be delivered, the court’s interim relief allows Yadav to continue his scientific work, which officials say is crucial for ongoing vaccine development.
