Hyderabad: Telangana High Court has dismissed a petition filed by a man alleging that his wife not cooking or sharing household chores with his mother, amounted to cruelty.
The court has clarified that when both husband and wife are employed, the inability to cook or assist the mother cannot be considered cruelty, and therefore, divorce cannot be granted on those grounds.
Telangana High court dismisses appeal:
A man from LB Nagar, Hyderabad, had filed a petition seeking divorce, claiming he was being subjected to cruelty by his wife.
A division bench comprising Justice Moushumi Bhattacharya and Justice Nagesh Bheemapak heard dismissed the appeal and upheld the family court's order refusing to dissolve the marriage.
Telangana HC: Staying with parents after miscarriage not cruelty
The court noted that the man gave conflicting statements regarding his wife's frequent visits to her parents' home and the duration she lived with him after marriage, stating five months on one occasion and three months on another, despite the marriage being one year and nine months old.
The court also noted that staying with her parents after a miscarriage cannot be considered cruelty. While the Supreme Court has held that demanding a separate residence constitutes cruelty, the High Court clarified that this depends on the facts of each case.
In this case, the wife did not propose a separate residence, it was her lawyer who suggested it and therefore, it cannot be considered cruelty.
